Virginia: judge delays release of rejected plea deal in DUI manslaughter case of Nicholas Perry Hansel

The smartest kids can do itFrom Student Press Law Center

VIRGINIA — A circuit court judge has declined a student news organization’s request to unseal a plea agreement rejected in a criminal case involving a Washington and Lee University student charged with the death of another student in a drunken-driving accident.

While he acknowledged the public has the right to access court proceedings and records, Judge Jay Swett determined the public’s access to the document would create substantial prejudice to the defendant’s fair trial rights, said Crovet, Va.-based attorney Alice Neff Lucan. Neff Lucan represented Brian Richardson, department head of Washington and Lee University’s Department of Journalism and Mass Communications, who argued in a Sept. 18 letter to the court that reporters at The Rockbridge Report news organization should have access to the rejected plea deal.

During a hearing Wednesday, the judge said the contents of the rejected plea agreement were so extraordinary “that he was worried opening it now would create so much adverse pretrial publicity they might have to change venue,” Richardson said. However, the judge ruled the records will be unsealed when the trial, which is scheduled to begin Jan. 20, ends.

“We would rather have had him order the thing open, but what he did say was it was the extraordinary circumstances of this one that overcame the presumption of access,” Richardson said in an interview. “He was very careful to say that the presumption here is not only that the public has standing to bring this, but that public access should be the norm.”

The judge did not elaborate what details in the rejected deal were so unusual, Richardson said.

In December 2013, Washington and Lee student Nicholas Perry Hansel gave 10 students a ride from a party in the country back to campus when he lost control of the vehicle and hit a tree stump, overturning the SUV. Kelsey Durkin, a 21-year-old senior at the university, was ejected from the vehicle and pronounced dead at a Lexington, Va., hospital, according to a story published by The Rockbridge Report, Washington and Lee University’s student-run broadcast and online news organization. Three other students were also hospitalized.

Hansel was charged with multiple offenses, including driving while intoxicated, maiming as a result of driving under the influence, reckless driving and aggravated involuntary manslaughter.

In August, Hansel’s attorney and a state prosecutor presented Judge Michael Irvine a negotiated plea agreement. After rejecting the agreement, Irvine recused himself from the case, as required by state law, and the Virginia Supreme Court appointed Swett to preside over the case.

On Sept. 18, Richardson, with assistance from several other Washington and Lee University professors, filed a motion to intervene, requesting the order to seal the plea agreement be withdrawn so Rockbridge Report student journalists could “report, write and broadcast stories about this important case.”

“This is a small community, it hit the community hard, practically everybody on campus knew somebody who was involved,” Richardson said. “In this case, there was a lot of attention being paid to how this case moved through the system, so we thought it was really important that people have access to public proceedings and public documents if at all possible.”

In a Sept. 19 letter to the court, prosecutor Robert Joyce, Jr. argued the proposed plea agreement, if made public, “would most certainly be prejudicial to one or both sides, and thereby very likely taint the jury pool when the case is tried in the future.

The public’s right to know, he said, “does not and should not override both the accused’s and the Commonwealth’s right to a fair trial.” …..MORE

Jared Hale sent to prison for 11 years for killing 3 Marines DUI

From OC Register
“HE NEVER APOLIGIZED OR TOOK RESPONSIBLILTY…”
A former Camp Pendleton Marine sergeant convicted of killing three other servicemen in a drunken-driving crash was sentenced Friday to more than a decade in prison, as an Orange County Superior Court judge denied his request for treatment rather than time behind bars.

Jared Hale, 27, told Judge Terri K. Flynn-Peister that for the rest of his life he will have to live with the loss of Sgt. Jeremiah Callahan, 23; Cpl. Christopher Arzola, 21; and Cpl. Jason Chleborad, 22, all of whom suffered fatal injuries in the 2012 crash in Dana Point.

“It’s been a rough five years,” Hale said, his voice unsteady with apparent emotion. “But there is just not much left of me, honestly.”

Hale still denied that he had had more than one drink of alcohol the day of the crash, when he was supposed of Marines during a night out at Hennessey’s Tavern. He claimed his elevated blood alcohol level – which was found after the crash to be more than twice the legal driving limit – may have been the result of binge drinking the night before.

Arguing that Hale’s drinking was an attempt to self-medicate in order to cope with post-traumatic stress disorder from his experiences in heavy combat in Sangin, Afghanistan, attorney William Paparian asked the judge to allow Hale to receive a shorter jail sentence followed by two years of alcohol-addiction treatment at a local facility. Paparian cited a state law that asks courts to consider whether the offense was committed as a result of trauma or injury from service in the military.

Flynn-Peister was unconvinced. While she noted that it was a “tragic case,” the judge said Hale had taken advantage of a position of trust due to his rank among the Marines, and noted that because of his blood alcohol content, Hale must have been drinking the day of the crash.

“The court does not find his story plausible or believable,” the judge said.

A half-dozen family members of the three Marines who died in the crash submitted victim impact statements that were read in court prior to Hale’s sentencing. Several asked for Hale to receive the maximum sentence, while most claimed that he had never apologized or taken responsibility for the crash.

“Mr. Hale failed his Marines that night in epic proportions,” wrote Austin Chleborad, Jason’s brother, who is also a Marine….MORE

From Los Angeles Times
A 25-year-old Marine stationed at Camp Pendleton was charged Wednesday with drunk driving in an Orange County crash that left three fellow Marines dead.
Jared Ray Hale, 25, faces three felony counts of vehicular manslaughter while intoxicated, with sentencing enhancement allegations for having a blood alcohol level of more than 0.15% and causing great bodily injury.

In the early morning hours of Feb. 14, prosecutors say, Hale drove away from a Dana Point bar with three friends in his Dodge Stratus. According to officials, the car was traveling at high speeds on Golden Lantern Drive near Terra Vista in Dana Point about 2 a.m., when Hale lost control of the car, which climbed the center median and wrapped itself around a tree.

Two Marines, 23-year-old Jeremiah Callahan of Nebraska and 21-year-old Christopher Arzola of Massachusetts, were pronounced dead at the scene.
Firefighters cut through the wreckage to rescue a third victim, Jason Chleborad of South Dakota, who later died at the hospital.  …MORE

Alcohol abuse in military worse than ever —

Alcohol abuse in the active-duty military is a bigger problem now than I’ve ever seen before,” says Bill Rider, president/CEO of American Combat Veterans of War (ACVOW), a non-profit organization that provides a wide variety of services for active-duty military and combat veterans making the transition to civilian life. He tells The Daily Beast that many Marines “drink during the day now, while on duty. It’s become very common.”

Rider, a retired Marine and Vietnam combat veteran who is independent but has an office at Camp Pendleton as well as at the San Diego Department of Veterans Affairs (VA), calls the incident in Dana Point “tragic but not surprising. We see Marines with drinking problems here (at ACVOW) every day. This terrible situation reflects an absolute failure of leadership. All the branches have abdicated their responsibility and turned this problem over to mental health professionals, who don’t really have answers, either. They’re just taking shots in the dark as to how to control drinking in the military.”    ….MORE

Santa Fe County DWI think safe bus adSanta Fe County DWI Program Launches New Campaign, Think SaFe

Santa Fe, NM – July 3, 2014 – The Santa Fe County DWI Program just rolled out a new public awareness campaign, Think SaFe. The focus is to remind people not to drink and drive.  Think SaFe is a reminder for everybody to Think about SaFety and Santa Fe.  The message: Be smart. Drinking and driving is never good.  Ever.  The campaign focuses on feeling SaFe by reducing DWIs by 1.) Making a Plan 2.) Calling a Cab and 3.) Report a DWI if you see it. Take pride in our community and take your safety into your own hands.

The campaign features a bus and van wrapped with the Think SaFe colors and message, coasters and napkins in bars with the Cab Ride Home telephone number.  Bar tenders and servers are also getting in on the Think SaFe message and soon, will be wearing Think SaFe t-shirts.

“Our new message Think SaFe is an invitation to think about the ridiculously easy way to avoid drunk driving and an appeal to think about the consequences if you don’t. Think SaFe Santa Fe. Think before you drink and drive,” said Lupe Sanchez, Santa Fe County DWI Program Coordinator.

Be smart. Drinking and driving is never good. Ever.

For more information contact Peter Olson at 505-992-9844/ 505-629-9278 or polson@santafecountynm.gov.

FROM KOAT:

If a person is convicted of DWI in the county, that person must call into the DWI Program every morning during their probation. There’s a chance that person will have to submit to a random urine test.

Since mid-August, the program has done about 1,400 urine tests. Officials say 77 percent of those come back negative for drugs or alcohol.

“People are really paying attention to this program and it is changing behavior, in my opinion,” said Sanchez.

Of those 1,400 tests, Sanchez said about 160 of them have come back positive for drugs or alcohol. When that happens, the court is notified, and a judge hands down a punishment. Sanchez said offenders in some cases have been put in jail for 1-3 days.

Sanchez admits he thought they’d see a higher number of positive test results when they first started the program, but it’s encouraging that the numbers tell a different story.

“The program’s working well. We want to continue it, but like I said, we want to also have it evaluated to make sure we’re headed in the right direction,” said Sanchez.

He said the plan is to have an outside firm look at and evaluate the program. He also said he wants it to run for another year to gather more statistics. …more

While not the actual rollover of the pickup in this crash, it is a similar one in a recent DUI rollover. They usually have about the same outcome - people are injured and killed. The driver whines about having to remember their lost friends for the rest of their lives - boo hoo - and the family of the dead kid has a graveyard to visit every year to place flowers on the kid's birthday. Ride with an impaired driver, buy a ticket to your own funeral.

Breanna Atwell killed when suspected DUI driver hit them head-on Shelton WA
Dead woman and her injured boyfriend spent their last moments together after Valentines evening together…then they were hit head-on by suspected DUI driver…

On her Facebook page, on Feb. 10, Atwell posted this: “okay I know valentines is Saturday but I just want you all to know how much I love this man of mine he is the sweetest man ever, I love you to the moon and back honey.” She posted a photo of her and Sammy Roark together. She was dead within five days.

SHELTON, WASHINGTON – Washington State Patrol reports that a head-on crash on State Route 101 two miles south of Shelton, Wa., took the life of Breanna Renee Atwell, 20, of Shelton, when the Severianao Lopez, 20, crossed the center line at 1:26 am on Feb. 15, 2015 and hit her vehicle. WSP Trooper J. Merritt reports that Atwell was not wearing her seatbelt when her 1992 Honda Accord was struck and totaled. Next of kin was notified by the Mason County Coroner.

Samuel John Roark III, 22, of Shelton was a passenger in Atwell’s vehicle and was taken by ambulance to Mason General Hospital. Police say that Roark wasn’t wearing a seatbelt either.

Lopez was operating a red 1990 Mazda northbound when colliding with the southbound Atwell vehicle which was totally demolished and the remains of the vehicle impounded as the investigation continues.

Lopez, who police say is suspected of being impaired by alcohol or drugs, was the one person of the three in the crash who was wearing a seat belt.

Charges are under investigation and pending.
