LOS ANGELES, CALIF. — 01/21/2016 — A 25-year-old man was sentenced today to 20 years to life, in the California state prison, for driving under the influence of alcohol and crashing into another vehicle, resulting in the death of an elderly woman, the Los Angeles County District Attorney’s Office announced.

On Oct. 22, 2015, a jury found defendant Juan Gabriel Rios guilty of five felonies in case KA108315: second-degree murder, gross vehicular manslaughter while intoxicated, driving under the influence of an alcoholic beverage causing injury, driving with a .08% blood-alcohol content causing injury and hit and run driving resulting in death or serious injury to another person.

Jurors also found true a special allegation that the defendant personally inflicted great bodily injury during the commission of the crime.

Deputy District Attorney Lauren Guber, who prosecuted the case, said in the late evening of Nov. 7, 2014, Rios was driving under the influence of alcohol when he attempted to enter the 10 Freeway and crashed into another vehicle near the Rosemead exit.

The victims, an elderly couple from Rosemead were hospitalized after the incident. However, the wife, Kit Ching Leung, ultimately succumbed to her injuries.

Following the collision, the defendant’s vehicle went down an embankment and Rios fled the scene.

Authorities were called and they soon located the defendant and arrested him in connection with the crash.

This case was investigated by the California Highway Patrol.

CHICAGO, ILL. — 01/22/2016 — A Northwest Side man has been charged with DUI in a Norwood Park crash that killed a passenger in his car, according to Chicago police.

Mishel Lame, 19, was driving a BMW coupe around 7:30 p.m. Monday when he rear-ended another car in the 5100 block of North Nagle Avenue, police said in a statement. The car was pushed into other cars, and the BMW also hit a tree, police said. 

A passenger in the BMW, Marion Mario Tahiraj, 20, was taken to Advocate Illinois Masonic Medical Center and pronounced dead.

01/22/2016 —  Riverside County Sheriff’s Department reports that on January 18, 2016, at 2:49 a.m., a La Quinta police officer located a blue 2007 Hyundai Elantra stopped in the roadway on Avenida Martinez. The officer pulled behind the vehicle and went to make contact with the driver. The vehicle suddenly accelerated away at a high rate of speed in an attempt to evade the officer. The officer ran back to his vehicle and attempted to catch up to the vehicle which lost control and collided with a fence and shrubbery at Avenida Martinez and Calle Sonora.

The driver later identified as Richard Jacob Hardin, 20, of La Quinta, fled the area on foot. It was determined the vehicle was registered to an address on Avenida Obregon and the driver was located a short time later at that address.

The driver, Richard Hardin, was determined to be under the influence of alcohol/and or drugs, and was arrested. He was taken to a local hospital for medical clearance and was then booked into the Riverside County Jail in Indio for driving under the influence and hit and run.

The La Quinta Police Department reminds people not to drink and drive and to call 911 to report drunk drivers.

01/22/2016  –Washington State Patrol reports that Trooper D. Wilkes is investigating a crash that took place at 9:44 pm on Jan. 21, 2016 two miles north of East Wenatchee in Douglas County, Washington.

A boy, 16-years-old, was reported by the Trooper to have been consuming alcohol and is being charged following a trip to Central Washington Hospital

The boozing teenager was operating a black 2015 Toyota Camry at a high rate of speed eastbound on State Route 2, according to the State Patrol, when a combination of inexperience behind the wheel combined with an abundance of stupidity fueled by booze caused him to strike a Jersey barrier. The booze cruise continued as the Toyota traveled on its roof for a distance before coming to a stop.  The upside down Toyota Turnover then blocked traffic.

The Washington State Patrol reports that the makeover given the Toyota Turnover was complete, leaving the owner of the vehicle without wheels as it was totaled.

According to the Lakeport Police Department, on Friday, January 22, 2016, at approximately 10:30 PM, Lakeport Police Officers were dispatched to the 1000 block of Lakeport Blvd. to investigate the report of a head-on vehicle collision.  While en route to the scene officers were further advised that one of the involved drivers may be intoxicated.

Upon arrival, officers determined that two vehicles, a blue 2012 Scion IQ (Suspect Vehicle) and a red 1999 Honda CRV (Victim Vehicle), had collided head-on in the east bound lane of Lakeport Blvd.  The driver of the victim vehicle was identified as a 19-year-old Lakeport female who is approximately nine months pregnant. At the time of the collision is was not known if she suffered any serious injuries.  A 21-year-old Lakeport male was riding as a passenger in the Honda, and he suffered serious injuries including possible broken bones.  Both victims were transported to Sutter Lakeside Hospital for treatment.  No further information on their condition is available at this time.

During the investigation, officers gathered information to indicate that at the time of the collision, the suspect vehicle was traveling west in the eastbound lane of Lakeport Blvd. at up to 60 MPH.

The driver of the suspect vehicle was identified as 31-year-old Kelseyville resident Athina Marlene Cook.  Emergency medical units from the Lakeport Fire Protection District (LFPD) evaluated Cook at the scene and determined that she did not have any injuries requiring her to be transported to a hospital.  Officers evaluated Cook, determined that she was intoxicated and placed her under arrest.  During the investigation, officers determined that Cook was currently on probation for a prior drunk driving conviction.

Officers transported Cook to Sutter Lakeside Hospital where she submitted to a blood alcohol test and was also medically cleared for booking.  Her blood alcohol results are not currently available.  Cook was then transported to the Lake County Correctional Facility where she was booked for felony drunk driving causing injury, reckless driving on a highway, driving while on drunk driving court probation, reckless driving causing a specified injury, reckless driving with injury and for being in violation of probation. She remains in custody on an NO BAIL hold.

 

Lakeport Police Officers last arrested Cook for drunk driving on October 7, 2012,  at approximately 2:00 AM after she came close to hitting an officer and three citizens on Armstrong St. while driving with a blood alcohol level of more than twice the legal limit.  In this case, the officer was only able to order the citizens out of the way, and himself get out of the way within seconds of being hit.

A 24-year-old man was in the Orange County Jail, accused of DUI-manslaughter following a crash between a Mercedes SUV and a golf cart.

Luis Jose Lopez Garduno, 24, also is accused of leaving the scene of a fatal accident and driving without a license.

Authorities say his SUV collided with a golf cart about 10 p.m. Jan. 19 on the campus of the Florida College of Integrative Medicine, near Sand Lake Road and South Orange Blossom Trail.

The driver of the golf cart was killed. The school’s website identified him as James Sensenbaugh, a campus security officer.

According to a report by the Florida Highway Patrol, the golf cart was crushed against a tree and the SUV had overturned in a school parking lot.

Lopez Garduno was found a short time later, hiding beneath a ramp at one of the school’s portable buildings, the report said.  ….MORE

A man charged with gross vehicular manslaughter and driving under the influence was arrested on suspicion of driving while high on either methadone or heroin, according to California Highway Patrol reports that were handed into the Kern County District Attorney’s office.

Jose Alfredo Garcia, 54, and his wife were on their way home to McFarland from Golden Mountain Casino in Porterville. The two were about 10 miles away from their house when Garcia crashed his Lexus into a pole near Cecil Avenue in Delano.

Garcia was taken to a local hospital with a broken left collarbone and a broken right heel, but his wife did not survive. She was later identified as 53-year-old Rosa Maria Trejo.

According to CHP reports, Garcia at first lied about being being the wheel. Officers said that Garcia gave them a “fictional” name, but they knew Garcia was the driver based off of the injuries he sustained in the crash. Garcia later admitted to being the driver, according to the reports.

 

 

Officers wrote that Garcia’s pupils were “constricted,” he was “nodding off,” and that his speech was “slow/slurred.”

“Garcia never asked about the condition of his wife,” wrote CHP Officer Hector Organista in the report. “I had to keep nudging Garcia to keep his attention on me.” ....MORE

Lake Charles – In a continuing effort to keep the citizens of Calcasieu Parish safe, the Calcasieu Parish Sheriff’s Office will be conducting a combination DWI checkpoint and a seatbelt checkpoint at an undisclosed location in the parish on Thursday, January 28.

This checkpoint will target individuals driving under the influence of alcohol and/or narcotics, which has been proven to be very effective in discouraging citizens from driving while impaired and people are more likely to designate a driver when they know sobriety checkpoints are being conducted. The checkpoint will also target people who are not wearing their seatbelt.

This checkpoint is funded by a grant from the Louisiana Highway Safety Commission.

The Calcasieu Parish District Attorney reports that on July 31, 2015, Ryan Allen Adams was sentenced to seven years in jail for one count of Vehicular Homicide. Adams pleaded guilty on April 13, 2015.

The first three years of the sentence will be served, while the last four years are suspended. Adams will spend the first year at the Calcasieu Correctional Center before being transferred to the Academy of Training Skills for the remainder of his sentence.

Following his release, Adams will be on supervised probation for four years.

Adams was driving a vehicle on October 19, 2013 when he left the road and struck a pole south of Lake Charles.

Calcasieu Parish District Attorney John DeRosier reports that on November 4, 2015, Judge Ron Ware sentenced Derek Paul Cooper, 29, to 18 years with the Louisiana Department of Corrections.

Cooper pleaded guilty on June 24, 2015, to one count of Vehicular Homicide. The conviction stems from an incident that occurred on September 27, 2014. Cooper was driving eastbound in the westbound lanes of Interstate 10 in the Sulphur area. He collided with another vehicle driven by 31-year-old Jeremy Olivier. Olivier was pronounced dead at the scene. At the time of the crash, Cooper’s blood alcohol content was 0.24, three times the legal limit.

Judge Ware ordered Cooper to serve 18 years in prison, with three years suspended and credit for time served. The first five years of the sentence must be served without the benefit of probation, parole or suspension of sentence. Following his release, Cooper will be on supervised probation for two years.

Lake Charles – On November 16, 2015, at approximately 9:50 p.m., a Calcasieu Parish Sheriff’s Office deputy conducted a traffic stop on a car near the intersection of W. McNeese Street and Lake Street for a traffic violation.

When the deputy spoke with the driver, Kourtnee J. Bourque, 27, 4511 Young Lane, Lake Charles, he detected an odor of alcohol emitting from her breath as well as slurred speech and unsteady balance. The deputy also observed an interlock device located on the passenger seat. When the deputy questioned Bourque she told the deputy she drank alcoholic beverages earlier in the day prior to driving. Bourque told the deputy she is required to have an interlock device to drive her vehicle due to a previous DWI, but her friend had removed the device for her so she can drive.

After Bourque performed poorly on a standard field sobriety test, she was arrested and transferred to the Calcasieu Parish Sheriff’s Office, where a breath intoxilyzer test revealed she was over the legal limit. Bourque, who has two prior DWI arrests, was booked into the Calcasieu Correctional Center charged with DWI 3rd; two brake lights required; and improper lane use. She was released on November 19 on a $26,000 bond set by Judge David Ritchie. Bourque’s special conditions of bond are that she must have ignition interlock device on any vehicle she drives and she cannot commit any other crimes.

Lake Charles – On December 22, at approximately 6:20 p.m., a Calcasieu Parish Sheriff’s Office deputy was dispatched to I-210 east bound near mile marker 6 to assist a vehicle with a blown tire that was causing a traffic jam.

When the deputy spoke with the driver, Henry P. Parker, 37, 212 Libby Street, Lake Charles, he detected an odor of alcohol emitting from his breath as well as slurred speech and unsteady balance.

Parker was transported to the Calcasieu Parish Sheriff’s Office, where he performed poorly on a standard field sobriety test. Parker then submitted to a breath intoxilyzer test, which revealed he was over the legal limit. Parker, who has two prior DWI arrests from 2015, was arrested and booked into the Calcasieu Correctional Center and charged with DWI 3rd; driving under suspension for prior DWI; and obstruction of public passage. Judge Clayton Davis set his bond at $8,500.

Lake Charles – On December 31 at approximately 8:00 p.m., a Calcasieu Parish Sheriff’s Office deputy was dispatched to Pete Seay Road in Sulphur in reference to a pickup truck stuck in a ditch.

When the deputy spoke with the driver, Patrick Godeaux Jr., 27, 1697 W. Burton Street, Sulphur, he had slurred speech and unsteady balance. Godeaux confirmed to deputies that he drove his truck after he took medication that was not prescribed to him. Godeaux was also found to be in possession of an open container of alcohol inside the truck.

He performed poorly on a standard field sobriety test. Godeaux, who has two prior DWI arrests in the last 10 years, was arrested and booked into the Calcasieu Correctional Center and charged with DWI 3rd; driving under suspension for prior DWI; careless operation; and open container. He was released on a $10,450 bond set by Judge Sharon Wilson. Godeaux’s special conditions of bond are he cannot operate a vehicle without ignition interlock device or a valid driver’s license.

Lake Charles – On January 10 at approximately 6:45 p.m., a Calcasieu Parish Sheriff’s Office deputy conducted a traffic stop on a car near the intersection of Highway 14 and Aquarius Street in Lake Charles for a traffic violation.

When the deputy spoke with the driver, Malena R. Cain, 30, 2014 Brenda Street, Lake Charles, he detected an odor of alcohol emitting from her breath. Cain told the deputy she drank alcoholic beverages prior to driving. Deputies also learned that Cain’s driver’s license was suspended for a prior DWI 2nd arrest.

After Cain performed poorly on a standard field sobriety test, she submitted to a breath intoxilyzer test which revealed she was over the legal limit. Cain was arrested and booked into the Calcasieu Correctional Center charged with DWI 3rd; driving under suspension for prior offenses; and no headlamps. She was released on January 11 on a $30,500 bond set by Judge Guy Bradberry.

Calcasieu Deputy Arrests Man For 4th DWI

Jeremy Dale Brummett 4th DWI on 032715 Calcasieu Parish Sheriff jailLake Charles – On March 27, 2015, at approximately 10:20 p.m., Calcasieu Parish Sheriff’s Office deputies responded to a report of a single-vehicle accident at the intersection River Road and Denison Road in Lake Charles.

Upon arrival, witnesses advised deputies the vehicle ran the stop sign and ran off the road and into a pasture.  Witnesses also told deputies the driver, later identified as Jeremy Dale Brummett, 38, of 3052 Alligator Park Road, Starks, was attempting to get the vehicle out of the pasture, but the vehicle was stuck in the mud.  When the deputy approached the vehicle and spoke with Brummett he appeared very unsteady on his feet.

After Brummett performed poorly on a standard field sobriety test, he was arrested and transferred to the Calcasieu Parish Sheriff’s Office, where a breath intoxilyzer test revealed he was over the legal limit.   Brummett, who has three prior DWI arrests and no valid driver’s license, was booked into the Calcasieu Correctional Center charged with DWI 4th; running a stop sign; and no driver’s license.

Judge David Ritchie set his bond at $103,500.

Eugene, Ore. — 01/29/2016 — The family of a Junction City man killed in a high-speed drunken-driving wreck lashed out Thursday at the stranger who will spend the next seven years in prison for causing their loved one’s death and then fleeing the crash scene.

Eugene resident Lee Volgardsen looked several of William Barnett’s relatives in the eye as they excoriated him during his sentencing hearing in Lane County Circuit Court, then apologized for his crimes and vowed to “do something to make it right.”

Volgardsen, 41, was sentenced to 85 months behind bars after pleading guilty to charges of second-degree manslaughter, failure to perform the duties of a driver to an injured person and driving under the influence of intoxicants.

Volgardsen was driving a rented 2016 Dodge Charger that authorities say was traveling well over 100 mph just before it veered off the road and crashed into a utility pole in the early morning hours of Nov. 25 on Washburn Lane, west of Junction City. His lone passenger, the 29-year-old Barnett, was killed in the wreck.

“It’s a tragic accident for (Barnett’s) family,” prosecutor Jay Hall said in court. He added that the stretch of road where the crash occurred is known locally “as a place where you can go out and drive fast.”

Volgardsen ran three miles to his girlfriend’s home immediately after the wreck. Authorities tracked down Volgardsen there hours later, and he admitted to them that he had crashed the car after drinking a fifth of rum and multiple beers, Hall said. ...MORE

On the morning of November 25th, 2015 “Dill” William Thomas Barnett passed away in a tragic motor vehicle accident. William was born on February 5th, 1986 in Eugene, Oregon and raised in the Harrisburg and Junction city area. During his younger years, William was a talented athlete, playing on numerous soccer teams and made the Oregon Olympic Development team as a goalie. He graduated from Junction City High School in 2004. William worked for the University of Oregon Athletic Department for several years and was also an independent landscaper who had a passion for plants. He dedicated his time to caring for his family and friends, whom he loved dearly. William is survived by his grandfather Joseph Barnett, parents Gary and Karessa Barnett, two sisters Felicia Barnett and Christina Courtright, 6 nieces and nephews, and numerous aunts, uncles, and cousins. He was an avid outdoor enthusiast who would spend weeks hiking, canoeing, camping, and fishing across Oregon. Donations can be made in his honor to the Oregon Department of Fish and Wildlife Bull Trout Enhancement Project, which William was very passionate about. Graves County Sheriff Dewayne Redmon reports that on January 28th at approximately 2:30 AM, his office investigated an incident that led to the arrest of a Boaz man on multiple charges.

The arrest came after a Graves County Deputy noticed a vehicle with no visible license plate making stops at several local businesses during the early morning hours in Mayfield. Some of these businesses were closed. This caused the deputy to investigate the circumstances. As the deputy’s patrol vehicle got behind this vehicle on Paris Road, the vehicle sped away. The deputy activated his emergency equipment to get the vehicle to stop. This caused the vehicle’s speed to increase. The vehicle eventually began traveling northbound on the State Route 121 Bypass. As officers of the Mayfield Police Department began arriving in the area, the deputy noticed sparks coming from the vehicle and then smoke. The vehicle then came to a stop and the operator fled on foot.

Two officers with the Mayfield Police Department were able to catch the subject on foot in the front lawn of Mayfield Elementary School. The subject was found to be in possession of plastic baggies containing methamphetamine, syringes, scales and other items. The subject was believed to be under the influence of methamphetamine at the time of the arrest. It was learned the subject was Calvin Bingham of Boaz.

Bingham is 22 years of age. It was determined that Mr Bingham had an active warrant for absconding by the Graves County Office of Probation and Parole. A computer inquiry also revealed that he had a suspended operator’s license. Mr Bingham was arrested on the warrant and for the following charges:
Reckless Driving
Fleeing or Evading Police in the First Degree
Operating a Motor Vehicle Under the Influence First Offense
Operating with a Suspended Operator’s License
Resisting Arrest
Possession of Controlled Substance in the First Degree
Drug Paraphernalia
Failure to Produce Insurance Card
No Registration Receipt
