Fatal New Year’s Day Crash Leaves One Dead in Hammond

Hammond, LA- Shortly after 5:00 AM on Sunday, January 1, 2017, Troopers from Louisiana State Police Troop L responded to a two-vehicle wrong direction fatal crash on Interstate 55 north of Wardline Rd. in Hammond. The crash has claimed the life of 23-year-old Christian Delgado of Hammond.

The preliminary investigation led Troopers to determine that the crash occurred as Delgado was driving a 1994 Honda Accord southbound in the northbound lane of Interstate 55.

Delgado crashed head-on into a northbound 2016 Freightliner tractor-trailer driven by 46-year-old Kenneth Mebane of Greensboro NC. Despite being properly restrained, Delgado sustained severe injuries in the crash. He was pronounced deceased on-scene by the Tangipahoa Parish Coroner’s Office. Mebane was also properly restrained at the time of the crash. He was not injured. Presently, impairment is suspected to have been a contributing factor in this crash. Troopers obtained blood samples from Delgado. As part of the on-going crash investigation, the samples will be sent to the Louisiana State Police Crime Lab for analysis. Mebane provided Troopers with a voluntary breath sample, which showed no trace amounts of alcohol present.

The difficult assignment of death notification continues to be one of the hardest elements of the Law Enforcement profession. Notification is even more difficult when Troopers know that the outcome was preventable. As 2017 begins, please take a moment to put the safety of you and your loved ones ahead of everything else. Aside from sound decisions behind the wheel, speak to your family and friends about the consequences of impaired driving. Remind them that putting on a seatbelt greatly reduces the chances of being killed or seriously injured in a crash. Speak to them about the dangers of distracted driving. The conversation you have today could be the difference tomorrow.

Officials with the Charleston County Coroner’s Office say 23-year-old Charles Cameron Cox from the Charleston area died at 2:19 a.m. at MUSC from blunt force injuries. Baker was booked on Jan. 1, 2017 at 4:28 am. 

At 1:22 a.m., Jan. 1, 2017, Charleston County Sheriff’s deputies reportedly responded to a single car collision on Ashley River Road near Wappoo Road.

Police said that responding deputies reported finding a beer can on the floorboard of the driver’s side and an empty beer box inside the car.

A report states Baker was in and out of consciousness as he spoke to a deputy.

The deputy said he could smell a strong odor of alcohol coming from Baker and advised him that he was under arrest.

CCSO officials said the accident began when a white Buick Park Avenue was traveling northbound on Ashley River Road at a high rate of speed.

“The vehicle slid across oncoming lanes and struck a tree stump in front of the Ashley Oaks Plaza,” CCSO officials said.

Funeral services have not yet been set for Cameron Cox. Baker faced a first bond hearing before a Judge on Jan. 1, 2017 and is still listed as an inmate in the jail.

Virginia State Police report Dale Donnells charged in fatal DUI crash that killed Thomas Estep; has pending DUI charge in Maryland

Dale Donnells charged with DUI homicide in Russell County Va by Virginia State Police

RUSSELL COUNTY, VA. – A Maryland man with a long record of DUI arrests and convictions who never served any serious jail time for those DUI convictions opened 2017 with a kill in rural Russell County, Va.

Virginia State Police Senior Trooper J.A. Minton is investigating the two-vehicle crash in Russell County which occurred Jan. 1, 2017, at 2:22 a.m., on Route 19 less than a mile south of Route 58.

A 2004 Chevrolet Silverado pickup truck was traveling south in the northbound lanes of Route 19 and struck head-on a northbound 2007 Pontiac G5.

The driver of the Pontiac, Thomas C. Estep, 21, of Norton, Va., died at the scene. He was wearing a seatbelt.

The driver of the Chevrolet, Dale Morgan Donnells, 41, of 8611 Cunningham Drive, Berwyn Heights, Md., was transported to Russell County Medical Center for the treatment of minor injuries. Upon his release, state police took him into custody and, at the direction of the Russell County Commonwealth’s Attorney, charged Donnells with DUI and aggravated involuntary manslaughter.

The Virginia State Police Wytheville Division Crash Reconstruction Team responded to the scene to assist with the crash investigation, which remains ongoing at this time.

Police say that Route 19 was re-opened by 7:45 a.m. Sunday, Jan. 1, 2017.

Prince George’s County, Md., Police Officer Battle arrested Donnells on Oct. 13, 2016 at 4:39 am on Glendale Blvd. at Daisy Lane, near where Donnells maintains another address in Maryland, at 12330 Daisy Lane. Donnells was charged with DUI while operating a 2001 Mazda. In that arrest, he was also charged with failing to control his speed to avoid a wreck.

In yet another DUI arrest, on Sept. 22, 1999, Donnells appealed in Prince Georges Circuit Court in Maryland a DUI conviction. On Oct. 8, 1999, Donnells failed to appear in court. On Feb. 3, 2000, Donnells was recorded as being in jail and on May 16, 2000, Montgomery County Circuit Court Judge Martha G. Kavanaugh sentenced Donnells to one year in jail with eight months and eight days suspended and supervised probation for one year. Debra Dwyer of Rockville was the attorney for Donnells.  A charge violation of probation was brought on Aug. 8, 2002, which Judge S. Michael Pincus dismissed. Judge Pincus had earlier sent Donnells to the Silver Spring, Md., Outpatient Treatment Program and to abide by all terms and conditions of probation as set forth in the probation contract. Court records show the case was closed satisfactorily on Aug. 14, 2002.

Donnells formerly lived on Chisolm Landing Way in North Potomac in Montgomery County where he was charged in burglary, theft and drug arrests in that county.

Two warrants for theft over $300 against Donnells were served on March 28, 1994, and in a plea bargain with the Montgomery County, Md. States Attorney on May 19, 1994, the charge was dropped with no fine and no time. Attorney Barry H. Helfand represented Donnells. Five criminal charges including malicious property destruction, battery, rogue and vagabond, and theft over $300 were dropped as part of the pleas on associated charges in the District Court of Montgomery County, Md., on the same date with Donnells pleading guilty to theft over $300. In the plea deal, Donnells was sentenced to eighteen months in jail with one year suspended and credit given for time served prior to his trial of 43 days. Donnells was put on probation until Sept. 7, 1996.

A charge of possession of drug paraphernalia was placed by Montgomery County Police Officer B. Trahan on Oct. 19, 1998, and in a plea deal with the Montgomery County States Attorney in District Court on May 17, 1999, Donnells entered a guilty plea and was fined $500 with $250 of the fine suspended and no time in jail.

The victim of this fatal collision has been identified as Michajla Bailey Kostecka (18yrs), a Santa Rosa resident.

Santa Rosa Police report that the driver and the suspect, Rebecca Iris Guillory, 19, has been additionally charged and booked at the Sonoma County Jail for violations:

On January 1, 2017, at approximately 11:00 pm Santa Rosa Police officers were dispatched to the area of Mountain Hawk Drive and Branch Owl Place. regarding a traffic collision involving a single motor vehicle. Officers arrived on scene and located a silver Chevy Cavalier on the west side of Mountain Hawk Drive, just south of Branch Owl Place. The vehicle had collided with a tree and had come to rest on the sidewalk facing north. The vehicle was completely totaled.

As Santa Rosa Police officers arrived on scene several citizens were attempting to help the driver who was conscious but trapped in the vehicle. Officers then located a deceased female in the front passenger seat. Fire personnel were able to extricate the trapped driver and she was transported to a local hospital

The driver of the silver Chevy Cavalier was later identified as Rebecca Iris Guillory, a resident of Santa Rosa. A preliminary investigation revealed there was probable cause to believe that Guillory was driving the Cavalier this evening while impaired by a possible combination of alcohol and drugs. Guillory had been admitted to hospital for minor injuries, however, she was placed under arrest for Felony DUI, causing death or serious bodily injury.

This investigation is ongoing as more information is gathered to determine the all of the specific circumstances surrounding the collision.

Santa Rosa, CA – The Santa Rosa Police Department Traffic Unit conducted a DUI/Driver’s License Checkpoint on Friday, December 30, 2016, in Santa Rosa between the hours of 7:00 p.m. and 1:30 a.m. The checkpoint was located on Stony Point Road near Stony Circle. Checkpoints are placed in locations that have the greatest opportunity for achieving drunk and drugged driving deterrence and provide the greatest safety for officers and the public.

Massachusetts: Fleeing OUI driver John Layton pinpointed by Police helicopter and caught by trooper for 5th arrest

According to the Massachusetts State Police at about 8 p.m., on December 31, 2016, Trooper Austin Dooley assigned to the State Police Barracks in Bourne responded to a single motor vehicle crash on the ramp of Route 25 eastbound from Route 195 eastbound in Wareham.  Upon Tpr. Dooley’s arrival he found the vehicle partially on the ramp and shoulder perpendicular to the roadway unattended.  The vehicle, a blue 2000 Nissan Quest had two different registration plates attached.

Witnesses at the scene provided Tpr. Dooley with a description of the operator who fled into the wood line.  State Police personnel from Troop D, Airwing and K9 along with members of the Wareham Police assisted in the search for the driver.

The operator later identified as JOHN LAYTON, 50, of Boston was located by the State Police Airwing lying in the prone position approximately 30 feet into the wood line.  With assistance from overhead, troopers were directed to LAYTON’s location where he was subsequently placed under arrest.

The S.C. Highway Patrol has charged Joseph Dewayne Knox with three counts of felony DUI in a triple-fatal head-on crash last October.

Three people, including two from Rock Hill and one from Chester, were killed Oct. 23 when police say Knox’s 2006 white Ford van struck a pickup truck head-on.

Chester County Coroner Terry Tinker identified those who died as Anthony “Tony” Lynn Roof, 46, of Chester; Willie James Perry, 76, of Rock Hill; and Sir Lawrence Darby, 53, of Rock Hill.   MORE

Mr. Anthony Lynn Roof, 48, died Sunday, October 23, 2016. A memorial service will be held at 2:00 PM on Saturday, October 29, 2016, at the home of Gordon Roof, 1252 Goldmine Rd., Chester, SC with Rev. Ronnie Green officiating. Interment will be private. The family will receive friends following the service.

Mr. Roof was born October 7, 1968, in Chester, SC and was a son of Gordon N. Roof and the late Diane Williams Greene. He was a carpenter.

In addition to his father, Gordon Roof of Chester, he is survived by one son, Tristen Lakota Glenn Millwood of Chester; one daughter, Heather Nicole Roof of Edgemoor; two brothers, Randy Roof and Neely Roof both of Chester; one grandchild, Marshall Allen Slade McCarty of Edgemoor; and a number of nieces and nephews. In addition to his mother, Mr. Roof was preceded in death by a brother, Mitchell Roof.

The Oklahoma Highway Patrol is asking for the public’s help with the investigation of the fatality collision that took the life of 37-year-old Amanda Carson of Yukon.

The crash happened at 11 p.m. December 31 when a silver 2010 Toyota Corolla driven by Craig Edward Maker of Edmond struck the rear of Carson’s vehicle at high speeds. Both were traveling on the Kilpatrick Turnpike in Canadian County.

The OHP is seeking information from anyone who saw or associated with Craig Edward Maker on the night of December 31, or anyone who was driving on the Kilpatrick Turnpike between 10:45 pm and 11:00 pm that night and might have seen the vehicle driven in a reckless manner.

RUTHER GLEN, VA. — Virginia State Police Sgt. Steve M. Vick reports that a Ruther Glen man operating a pickup truck crossed the center line of Ladysmith Road while traveling westbound and struck a Caroline County Sheriff’s cruiser head-on, seriously injuring the deputy operating the cruiser.

The crash involving Caroline County Deputy H. S. McGhee which occurred around 5 am on Ladysmith Road west of Balty Road in Caroline County resulted in the deputy being transported to Mary Washington Hospital in serious, but a non-life threatening condition with injuries to his lower body. The Virginia State Police are working the crash at the request of Sheriff Tony Lippa.

Police report that Neal Bradford Hambleton, 30, of Ruther Glen, Va., was charged with a DUI-1st offense, concealed a weapon while intoxicated and DUI-maiming. Hambleton is incarcerated at the Pamunkey Regional Jail.  Hambleton was booked into the jail at 9:20 am after being charged by Virginia State Trooper A. Lubbers on Jan. 7, 2017.  Jail records show his height at 6’7” and weight 245 pounds. Hambleton’s BAC was listed as between .15 and .20 on jail records.

Sheriff Lippa is at Deputy McGhee’s hospital room currently. McGhee, 25, has suffered a fractured left femur, a fractured right lower leg, and a fractured foot, along with some soft tissue injuries.

An orthopedic surgeon has already seen Deputy McGhee, and McGhee will have surgery to correct his fractures today.

“Deputy McGhee is in good spirits, and all of us at the Caroline County Sheriff’s Office wish him a speedy recovery,” said Sheriff Lippa.

Bus driver Dorothy Burse denies she was under the influence of drugs. Florida Highway Patrol says she was driving under the influence of narcotics. Burse says she is only taking antibiotics and vitamins.

PINELLAS COUNTY, Fla. (WFLA) – A school bus driver was arrested for driving under the influence on Tuesday after a minor collision.

The Florida Highway Patrol said Dorothy Burse, of Largo, was driving the school bus westbound on 54th Avenue North.

The bus stopped at a red traffic signal at 66th Street North, when another vehicle traveling westbound crashed into the rear of the bus.

Seven middle school students from Lealman Innovative were on board at the time of the accident. They weren’t hurt.

Following the collision, the driver of the vehicle left the scene.

Troopers later arrested Burse for driving under the influence of a controlled substance and child neglect.

Newberry Township Police Chief John Snyder Cites Pennsylvania’s Weak DUI Laws

“When I see innocent people injured or killed because of impaired drivers, I ask myself each time, why do Pennsylvanians tolerate this? Why do our politicians in Harrisburg keep looking the other way? The bodies are piling up and all we as police officers can do is keep fighting the fight on impaired driving enforcement. We need tougher DUI laws.”

HARRISBURG, Pa. (01/10/2017) – Are Pennsylvania’s DUI laws too lenient? The question is being asked following a Facebook post from a police chief following a double fatal crash.

On Saturday, police said Anthony Fickes lost control of his SUV and slammed into another vehicle on Old Trail Road in Newberry Township. Fickes was killed and so was Edna Mikos, 66-year-old from York Haven, who was a passenger in the other vehicle.

Police said they found open bottles and cans of alcohol, both inside of Fickes vehicle.

Shortly after the crash, Newberry Township Police Chief John Snyder posted a lengthy Facebook message. Part of the post, which includes the phrase “bodies are piling up” calls for lawmakers to make tougher DUI laws.

The social media rant also includes a section where Snyder cites a study that says Pennsylvania DUI laws are some of the worst in the country.

“In my experience, there’s no question that Pennsylvania needs to take DUI cases more seriously than we do,” Craig Stedman, the Lancaster County District Attorney, said. “There’s a number of areas I think we can improve upon. One of the things we talk about is repeat offenders.”

Stedman said he would like to see a system where repeat DUI offenders turn into felonies. He also said 32 other states have a penalty where DUI offenders lose their car if they’re convicted of a second DUI.

“I’m tired of seeing the innocent people getting killed by this stuff,” Stedman told ABC 27 News. “We need to make a consequence such that it deters people.”

BOWIE, MD. — As St. Mary’s County Sheriff Tim Cameron wrestles with how to handle the recent DUI crash and arrest which involved one of his deputies and a correctional officer while on a mission in Talbot County to learn how to carry caskets for official funerals; Charles County Sheriff Troy Berry has to worry about an important criminal case being affected by the DUI arrest of one of his detectives in Prince George’s County.

After a reported Christmas Eve stopover at a bar in Bowie, Charles County Detective Young Jack Austin, 43, of Pomfret, Md., was arrested for DUI by a City of Bowie Police Officer while he drove an official police vehicle, a 2008 Chevrolet with Maryland tag number 14364M5 on Hindle Lane, in Bowie, Md.

The driver was located and appeared to be under the influence of alcohol. It was also learned at this time that the driver was an off-duty Charles County Sheriff Deputy and the vehicle was his issued unmarked cruiser.

The following is the report from the Bowie Police:

SYNOPSIS OF INCIDENT:
On 12/23/16, Units responded to the area of Hindle Lane for an unknown trouble. Once in the area, Units discovered a vehicle on the bike path from Holiday Lane at Old Collington Rd. It was then determined to be an accident. The driver was located and appeared to be under the influence of alcohol. It was also learned at this time that the driver was an off-duty Charles County Sheriff Deputy and the vehicle was his issued unmarked cruiser. Sgt. Rodriguez made notifications to C.C.S.D. and Sgt. Celia responded to the Bowie Police Station. After failing Field Sobriety Tests, the driver was transported to PGPD District 2 where he refused a breath test. He was then transported to the Bowie Police Station and charged. His duty weapon was surrendered to Sgt. Celia. The accident was a single vehicle accident with no injuries.

Charles County Sheriff’s Spokesperson Diane Richardson confirmed to THE CHESAPEAKE TODAY that Detective Austin is on paid leave pending the outcome of the charges and internal investigation.

Court records do not recite any pending court date in District Court for Prince George’s County perhaps due to the involvement of Detective Austin in a high-profile criminal trial currently underway.

It is unknown if Detective Austin was part of the ‘Shop with a Cop’ program on Christmas Eve or if he was simply getting a few holiday drinks with a cop in Bowie. The Bowie Police Department provided a video of their Chief participating in the ‘Shop with a Cop’

Detective Austin was honored by Charles County Sheriff Troy Berry in October of 2016, at an awards ceremony.

The victim was eventually able to convince her attacker to let her use the bathroom. Only then was she able to escape through a window. The investigation was assigned to Detective Austin, who worked tirelessly on the case to ensure the suspect was prosecuted to the fullest extent. At his trial, the suspect was found guilty and was sentenced to life in prison plus 30 years.

Since the attack, Det. Austin has maintained contact with the victim and has been a valuable resource to her, even during his off-duty time. The victim credits Detective Austin, among others, with helping her turn her life around and move in a positive direction.  For his exceptional work on this and every domestic case he investigates, Detective Austin was awarded the Making a Difference Award in the Law Enforcement category.

On May 10, 2014, Charles County sheriff’s officers assigned to the Warrant Unit located Stephen Dale Nolan, 38, of La Plata, who was wanted in connection with a brutal assault of a female acquaintance that occurred on May 8, 2014. Nolan was located in Hughesville after investigators developed information about his possible whereabouts and tracked down all leads until he was found. Nolan was charged with first-degree assault, second-degree assault, first-degree sex offense, second-degree sex offense and other charges.

POLICE AGENCIES WRESTLE WITH DUI OFFICER PROBLEM

Many law enforcement agencies generally have at least one such DUI arrest of an officer in any given year, some of which involve fatal crashes.  Police officers have as much, or perhaps much more stress on the job than many other professions which often leads to alcoholism. While there are those officers in law enforcement who clearly exhibit arrogance, and decide to drive after drinking, many make the same mistake as others do in life and simply make a bad decision. While the public supports the police in overwhelming numbers, the public also supports sobriety checkpoints in overwhelming numbers as most folks simply want to get home alive and not be killed by a DUI driver.

The nationwide DWI HIT PARADE has chronicled the arrests of 290 police officers for driving under the influence since 2011. Other occupations are listed as well, including politicians, celebrities, judges and lawyers, clergy and news reporters and editors.

A 2013 study by Bowling Green State University on what happens when a police officer is arrested for DUI while on duty provides one of the few glimpses that have been chronicled on the topic.

This segment of the study focused on news coverage of the DUI Police Officer scandals, stories that were over the top in nature, due mostly to the explosive nature of the events rather than a simple arrest on the side of the road.

Scandals involving law enforcement officers who drive drunk run counter to the widely-recognized slogans of police-sponsored public service campaigns to promote sober driving: “Drive sober or get pulled over, “…”Over the limit, under arrest, “…”Drink, drive, go to jail” (Governors Highway Safety Association 2012, National Highway Traffic Safety Administration 2012, Texas Department of Transportation 2012). One scandal involved an intoxicated officer who joined a high-speed pursuit and rammed his patrol car into three motorcyclists stopped at a red light. Charges including reckless homicide were eventually dropped in part because of a botched investigation that also ultimately led to the police chief’s resignation (Indianapolis Star 2012). Another case involved a drunken police commander who crashed into a second vehicle, left the scene, and then helped to stage a phony accident to cover-up the initial crash. Blood-alcohol tests were not conducted at the scene, even though the commander’s speech was slurred, he smelled of alcohol, and he had wet his pants (Fazlollah 2001, Banks 2013). Another scandal involved a police lieutenant arrested—but not convicted—for driving under the influence three separate times over a seven-month period. He was finally convicted on a DUI charge that resulted from a fourth arrest that occurred three months later (Castaneda 2008, Davis 2008).

The problem of police officers driving drunk may be far more under-reported since on-duty officers may or may not arrest another police officer for driving under the influence. In the cases of those police officers arrested for DUI, the arrest would not have taken place were it not that the arresting officer was doing his or her job properly.

Police DUI’s have the potential to substantially weaken public trust and the legitimacy of strategies designed to mitigate drunk driving because the drunk driver in these cases is among those expected to enforce DUI laws and protect society from drivers who are intoxicated. Recent evidence suggests that the problem may be exacerbated by officers and agencies that minimize—and in some cases purposively ignore—the problem of drunk driving among police.

A Bureau of Justice Statistics survey reported that over one-third of responding state and local police agencies would consider police applicants with a prior DUI conviction (Reaves 2012). Likewise, a majority of officers responding to a survey on police integrity said they would not report a fellow officer who had a minor traffic accident while driving under the influence of alcohol (Klockars et al. 2000). Recent journalistic investigations in Milwaukee (Barton 2011), Denver (McGhee 2011), and New York City (Paddock and Lesser 2010) reported disturbing cases in which police found to have driven drunk were either not arrested and/or otherwise minimally punished. The tendency of officers and at least some police executives to disregard police DUI’s limits the potential for research and the availability of data on the problem, and also inhibits the development of strategies to identify, punish, and deter drunk driving among police officers.

A loaded syringe was also found on the floorboard next to a container of baby formula.

The Sarasota County Sheriff’s Office arrested a Manatee County couple after first responders found them passed out in a car with two infants in the backseat.

Deputies were called to the Texaco gas station located at 19 East Road, Sarasota, just after 8:00 a.m. on Thursday, for the report of two possible overdoses. When deputies arrived they located driver William Ballard, DOB 02/02/80, and passenger Delaney Crissinger, DOB 04/28/84, passed out in the front seat of a black SUV with the engine running.

Crissinger was holding a clear baggy containing .61 grams of methamphetamine and after a search of the vehicle, deputies recovered another nearly 2 grams of the drug, .38 grams of fentanyl and heroin, baggies, a scale, and spoon. A loaded syringe was also found on the floorboard next to a container of baby formula.

Two infants, ages 5 and 18 months, were secured in car seats in the backseat. Crissinger was holding a clear baggy containing .61 grams of methamphetamine and after a search of the vehicle, deputies recovered another nearly 2 grams of the drug, .38 grams of fentanyl and heroin, baggies, a scale, and spoon. A loaded syringe was also found on the floorboard next to a container of baby formula. The couple was arrested and taken to the Sarasota County jail.

Ballard is charged with Child Neglect, Possession of Heroin with Intent to Sell, Possession of Methamphetamine with Intent to Sell, and Driving with a Suspended License. He is currently in custody on $30,120 bond. Crissinger also faces charges of Child Neglect, Possession of Methamphetamine and Possession of Narcotics Equipment. During a first appearance hearing, the judge set her bond at $17,000.

 CITIZENS CAME TO AID OF TROOPER

Hammond, Lake County- Indiana State Police report that a Chicago man stopped for a traffic violation fled from and fought with a trooper and ended up at the Lake County Jail.

At approximately 9:29 p.m., February 10, 2017, Indiana State Trooper Alaa Hamed had exited the Indiana Toll Road onto Indianapolis Boulevard (Blvd) in Hammond when he saw a 2001 Buick Century go by at a high rate of speed, passing other vehicles, and disregard a traffic control device.  The Buick drove through a red light and stop in the middle of the intersection of Indianapolis Blvd and 110th/108th Streets in Hammond.  Hamed activated his emergency lights and pulled behind the Buick.

As Hamed approached the car he saw two males in the front seat.  When the driver, later identified by an Illinois driver’s license as Marques J. Bates, 30 of Chicago, Illinois, lowered his window an overwhelming odor of alcoholic beverage and other indicators from Bates that he may be intoxicated.

Bates was given a field sobriety test and a portable breath test.  He was then read implied consent to which he agreed.  Shortly thereafter, Bates became verbally combative and began to resist when Hamed tried to place handcuffs on him.  Bates attempted to walk away from Hamed.

Hamed attempted to detain Bates who pulled away from Hamed and ran east into the grassy/muddy field with Hamed behind him and pushed Hamed.  Bates then fled on foot northbound on Indianapolis Blvd towards 108th St.

Hamed returned to his police car and drove north on Indianapolis Blvd. and blocked off northbound lanes with his police car.  Bates then turned around and ran southbound on Indianapolis Blvd. towards 110th St.  Hamed left his police car and pursued Bates on foot.

At one point, Bates turned around and faced Hamed who ordered Bates to get on the ground by gunpoint, yet Bates fled again with Hamed in pursuit.  Bates ran northbound in the southbound lanes of on-coming traffic on Indianapolis Blvd. where Hamed had to physically tackle him.

Two Good Samaritans assisted Hamed with restraining Bates and he was able to finish handcuffing him and placing him in his police car.

 

While on the ground, a fight ensued, where Bates struck Hamed several times.  After fighting for a couple of minutes Hamed was able to get Bates right hand and began to handcuff him.  Two Good Samaritans assisted Hamed with restraining Bates and he was able to finish handcuffing him and placing him in his police car.

Trooper George Hornsby, Hammond Police, and Hammond Fire EMS arrived.  Both Bates and Hamed were medically cleared at the scene.

Bates again became combative and was transported to the Lake County Jail in Crown Point.

The passenger was released who was sober.

Bates was charged with:  Battery on a Law Enforcement Officer (Level 6 Felony), Resisting Law Enforcement (Class A Misdemeanor), Operating While Intoxicated Refusal (Class A Misdemeanor) and Operating While Intoxicated Endangering (Class C Misdemeanor)

Rocky McMurray arrested on impaired driving charges for killing Steven Ahaus; Judge holds him on million dollar bond – 2nd time he has killed while driving drunk

AURORA, INDIANA — Indiana State Police report that on Jan. 24, 2017, at approximately 6:00 pm, the Indiana State Police served an arrest warrant on an Aurora, Indiana man for charges related to the January 24th crash that killed a Moores Hill man.

The investigation by Trooper Kyle Stovall, began on January 24, 2017, when troopers responded to a head-on collision on Sparta Pike near County Road 350 in Moores Hill, Indiana.  The crash investigation by Trooper Andrew Garrett determined that a red 1999 Dodge Grand Caravan, being driven by Rocky McMurray, age 47, Aurora, Indiana was traveling eastbound on Sparta Pike and drove left of center into the path of a 2005 Dodge Neon being driven by Steven Ahaus, age 48, Moores Hill, Indiana.  Ahaus died as a result of the collision.

The criminal investigation by Trooper Stovall determined that McMurray was believed to be intoxicated at the time of the crash.  He tested over twice the legal limit on a preliminary breath test at the scene.  McMurray also submitted to a blood test while he was hospitalized after the crash.  Those results are still pending.

The investigation was turned over to the Dearborn County Prosecutor’s Office which ultimately led to a warrant being issued for McMurray’s arrest on charges of Reckless Homicide, Operating While Intoxicated-Causing Death, and Operating While Intoxicated While Endangering a Person.  Trooper Garrett and Trooper Travis Linville located McMurray at his residence and arrested him on the charges.

He was incarcerated in the Dearborn County Jail pending his initial court appearance.

 

McMurray made his initial appearance in Dearborn Superior Court II on Monday. Deputy prosecutor Andrew Krumwied told Judge Sally Blankenship that McMurray has a 2005 conviction for manslaughter in Kentucky in relation to another wreck he caused which claimed another man’s life.

“This is the second time he is alleged to have killed a man in a drunk driving accident,” Krumwied said.

Krumwied also recapped McMurray’s previous OWI convictions in Indiana.

Blankenship set McMurray’s bond at $1 million surety and $250,000 cash. The judge cited his criminal history, potential flight risk, and community safety in placing the high bond amount. His driving privileges were also revoked.   MORE
